Terms of Service

These Terms of Service ("Terms") govern your use of zSign ("the Service", "we", "us"), an electronic signature service. By creating an account, sending a document for signature, or signing a document through the Service, you agree to these Terms. If you do not agree, do not use the Service.

zSign lets senders upload documents, request signatures, and lets recipients review and sign those documents electronically. We provide the signing infrastructure only: we are not a party to any agreement signed through the Service, and we do not review, endorse, or take responsibility for the content of any document.

By signing a document through the Service, you consent to conduct the transaction electronically and to the use of electronic records and signatures, consistent with the U.S. ESIGN Act, UETA, and similar laws in other jurisdictions. You agree that your electronic signature is intended to have the same legal effect as a handwritten signature.

If you do not wish to sign electronically, do not proceed with signing; contact the sender to arrange an alternative method.

To support the integrity and evidentiary value of signed documents, the Service records signing events in an audit trail. This includes the signer's name and email address as provided, IP address, browser information, document view and signature timestamps, and cryptographic hashes of the document. All parties to a document consent to this recording as a condition of using the Service, and audit trail records may be retained after a document is completed or an account is closed, to preserve the validity of completed documents.

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for activity under your account. You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service.

You agree not to use the Service to:

• sign or request signatures on behalf of someone else without authority, or otherwise impersonate any person;
• upload or distribute unlawful, fraudulent, or infringing content;
• attempt to forge, alter, or repudiate signatures or audit records;
• probe, disrupt, or circumvent the Service's security or rate limits.

We may suspend or terminate accounts that violate these Terms.

You retain all rights to documents you upload. You grant us a limited license to store, process, transmit, and display those documents solely to provide the Service — for example, rendering them for signers, merging signatures, generating completion certificates, and delivering completed copies to the parties.

The Service can optionally generate AI-powered document summaries. When enabled, document content is processed by a third-party AI provider for that purpose only. Senders can disable AI processing per document. AI summaries are informational and are not legal advice; the signed document alone is authoritative.

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. We are not a law firm and do not provide legal advice. We do not warrant that documents signed through the Service will be valid or enforceable in every jurisdiction or for every document type — some documents (for example, wills or certain notarized instruments) may not be eligible for electronic signature under applicable law. You are responsible for determining whether electronic signature is appropriate for your documents.

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business, arising from your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim or USD $100.

You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or to protect the Service and its users. Completed documents and their audit trails may be preserved after termination as described in Section 4 and in our Privacy Policy.

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above, and continued use of the Service after changes take effect constitutes acceptance.
